OVERVIEW
Welcome to Mediterranean Week. In these Terms of Service, the terms “Mediterranean Week,” “we,” “us,” and “our” refer to Mediterranean Week.
Mediterranean Week operates this website, store, customer account area, subscription services, and related digital tools and content (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you. Shopify allows merchants to publish store policies such as Terms of Service, Privacy Policy, Refund Policy, and Subscription Policy, but merchants remain responsible for ensuring those policies accurately reflect their business and legal obligations.
These Terms of Service (“Terms”) govern your use of the Services, including browsing our website, creating an account, purchasing a subscription, accessing digital meal plans, and communicating with us.
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, Refund Policy, and Subscription Policy, each of which is incorporated into these Terms by reference. If you do not agree, you must not use the Services.
1. ELIGIBILITY AND ACCOUNTS
To use the Services, you must be at least the age of majority in your place of residence. If you reside in British Columbia, the age of majority is 19.
You agree to provide accurate, current, and complete information when creating an account, placing an order, or otherwise using the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You may not transfer, sell, assign, or sub-license your account to another person.
2. OUR SERVICES AND PRODUCTS
Mediterranean Week provides digital subscription-based meal planning content, including weekly and monthly Mediterranean meal plans, recipes, grocery guidance, and related digital materials.
Unless expressly stated otherwise, our products are:
- digital, not physical goods;
- delivered through customer account access, email, downloadable files, or hosted web pages; and
- offered for your personal, non-commercial use only.
We may update, improve, modify, suspend, or discontinue any part of the Services or any plan content at any time.
We make reasonable efforts to describe our Services accurately, but we do not guarantee that every description, feature, format, or presentation will be identical across all devices, browsers, email clients, or platforms.
3. ORDERS AND ACCEPTANCE
When you place an order, you are making an offer to purchase a subscription or digital product. We reserve the right to accept, reject, limit, or cancel any order at our discretion.
Your order is not accepted until payment is successfully processed and we confirm the order.
We may refuse or cancel an order for reasons including, but not limited to:
- suspected fraud or misuse;
- pricing or technical errors;
- product or subscription unavailability;
- violation of these Terms; or
- other legitimate business reasons.
If we cancel an order after payment has been processed, we will issue a refund where appropriate.
4. PRICING, BILLING, AND TAXES
Prices are shown in the currency displayed at checkout unless otherwise stated. Prices and promotions may change at any time without notice.
You agree to provide current, complete, and accurate billing and payment information for all purchases. You authorize us and our payment providers to charge the payment method you provide for all amounts due, including subscription renewals, applicable taxes, and any other charges disclosed at checkout.
You are responsible for any applicable taxes, duties, or similar charges associated with your purchase, except where we are required by law to collect and remit them.
5. SUBSCRIPTIONS
Some Mediterranean Week products are sold on a recurring subscription basis. By purchasing a subscription, you agree that:
- your subscription renews automatically unless cancelled;
- you authorize recurring charges using your selected payment method;
- billing frequency and price are as disclosed at checkout and in the applicable product page or Subscription Policy;
- you may manage or cancel your subscription through your customer account or subscription portal, subject to our Subscription Policy.
Cancellation will stop future renewals, but does not automatically entitle you to a refund for the current billing period unless stated in our Refund Policy or required by law.
6. DIGITAL DELIVERY AND ACCESS
Because Mediterranean Week provides digital products and subscription services, no physical shipping applies unless we explicitly state otherwise.
Plan access may be provided through one or more of the following:
- customer account pages;
- email links;
- hosted web pages;
- downloadable PDF files; or
- subscription/customer portal access.
You are responsible for:
- using a valid email address;
- checking your inbox, spam, promotions, or similar tabs for access emails;
- maintaining access to your customer account; and
- ensuring your device, browser, and internet connection are suitable for accessing digital content.
We are not responsible for delays caused by your email provider, spam filtering, login issues caused by incorrect customer information, or platform outages outside our reasonable control.
7. CUSTOMER ACCOUNT AND SUBSCRIPTION PORTAL
If you create an account, your account may include features such as:
- order history;
- meal plan access;
- subscription status;
- billing management; and
- cancellation or renewal controls.
You are responsible for reviewing your account information and keeping it accurate.
We may suspend or restrict access to your account if we reasonably believe there has been fraud, unauthorized use, abuse, or a violation of these Terms.
8. REFUNDS AND CANCELLATIONS
All refunds, cancellations, and subscription-related billing outcomes are governed by our Refund Policy and Subscription Policy.
Because our products are primarily digital and subscription-based, refunds may be limited once access has been granted, except where required by law or where our Refund Policy expressly allows one.
9. PERSONAL USE ONLY
Mediterranean Week subscriptions, meal plans, recipes, and related materials are licensed to you for your personal, non-commercial use only.
You may not:
- reproduce, resell, redistribute, sublicense, or share access to paid content;
- upload our paid materials to public or shared repositories;
- provide your account access to another person outside your household, if such sharing is not permitted by the product terms;
- use our materials for commercial meal-planning services, coaching, or resale.
10. INTELLECTUAL PROPERTY
All content included in the Services, including text, recipes, plan structures, graphics, logos, designs, downloads, page layouts, email content, and other materials, is owned by or licensed to Mediterranean Week and is protected by applicable intellectual property laws.
These Terms do not transfer any ownership rights to you. Except for the limited personal-use rights expressly granted, all rights are reserved.
11. USER FEEDBACK AND REVIEWS
If you submit suggestions, comments, reviews, testimonials, or other feedback to us, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, and display that feedback in connection with our business, marketing, and Services.
You represent that any feedback you submit:
- is truthful to the best of your knowledge;
- does not violate the rights of others; and
- does not contain unlawful, abusive, defamatory, or misleading material.
We may remove reviews or submissions at our discretion.
12. THIRD-PARTY SERVICES AND LINKS
The Services may include integrations, tools, or links provided by third parties, including Shopify, payment processors, subscription tools, analytics providers, and email service providers such as Klaviyo.
We are not responsible for third-party services, websites, or platforms that we do not control. Your use of those services may also be subject to their own terms and privacy policies.
13. PROHIBITED USES
You may not use the Services:
- for any unlawful purpose;
- to violate any applicable law or regulation;
- to infringe intellectual property or privacy rights;
- to interfere with the security or operation of the Services;
- to use scraping, bots, spiders, automated extraction tools, or similar systems without our written permission;
- to attempt unauthorized access to accounts, systems, or content;
- to upload malware, malicious code, or harmful content;
- to misuse subscription access or circumvent access restrictions.
We may suspend, limit, or terminate access if we believe you have violated these Terms.
14. AI AGENTS AND AUTOMATED ACCESS
You may not use automated agents, bots, or similar tools to access, monitor, extract, or interact with the Services in a way that:
- disguises automated activity as human use;
- bypasses technical controls or access restrictions;
- interferes with site functionality; or
- imposes unreasonable load on our systems.
We may block, restrict, or refuse automated access at any time.
15. DISCLAIMER OF HEALTH, NUTRITION, AND LIFESTYLE INFORMATION
Mediterranean Week provides meal-planning, recipe, and lifestyle content for general informational purposes only.
Our Services are not medical, nutritional, dietetic, or professional health advice, and are not intended to diagnose, treat, cure, or prevent any disease or health condition.
You are responsible for determining whether any recipe, ingredient, or meal plan is appropriate for you, including in relation to allergies, intolerances, health conditions, medications, pregnancy, or dietary requirements. You should consult a qualified professional where appropriate.
16. SERVICE AVAILABILITY
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.
From time to time, access may be affected by:
- maintenance;
- software issues;
- third-party platform outages;
- internet or hosting failures; or
- circumstances outside our control.
We may modify, pause, or discontinue all or part of the Services at any time.
17. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services and all digital products, content, and subscriptions are provided on an “as is” and “as available” basis, without warranties, representations, or conditions of any kind, whether express, implied, or statutory.
We disclaim all implied warranties or conditions, including merchantability, fitness for a particular purpose, durability, title, and non-infringement, except to the extent such disclaimers are prohibited by applicable law.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mediterranean Week and its owners, affiliates, service providers, contractors, and licensors will not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, loss of goodwill, or business interruption, arising out of or related to your use of the Services.
Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the amount you paid to us for the specific product or subscription giving rise to the claim in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
19. INDEMNITY
You agree to indemnify and hold harmless Mediterranean Week and its affiliates, contractors, service providers, and licensors from claims, losses, liabilities, damages, and expenses arising out of:
- your misuse of the Services;
- your breach of these Terms;
- your violation of applicable law; or
- your infringement of any third-party rights.
20. TERMINATION
We may suspend or terminate your access to the Services at any time if:
- you violate these Terms;
- payment fails and access must be restricted;
- we suspect fraud, misuse, or unlawful conduct; or
- we discontinue the relevant Service.
Termination does not affect obligations or rights that by their nature should survive termination.
21. GOVERNING LAW
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts of British Columbia, unless applicable consumer protection law requires otherwise.
22. CHANGES TO THESE TERMS
We may update these Terms from time to time. If we make material changes, we will post the updated version on our website and update the “Last updated” date above. Your continued use of the Services after updated Terms take effect constitutes acceptance of the revised Terms.
23. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
24. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, Subscription Policy, and any other policies expressly incorporated by reference, form the entire agreement between you and Mediterranean Week regarding the Services.
